Terms of Service
Effective: April 2026
§ 1 Scope
These Terms and Conditions govern the contractual relationship between Odin Adventure Labs LLC and users of the malla app. By registering, you accept these Terms.
§ 2 Services
- Love, Friends and Group modes (matches, chat).
- Event discovery with RSVP functionality.
- Exclusive partner benefits and discounts.
- Community features (groups, shared events, guest lists).
§ 3 Registration & Account
- Minimum age 18.
- True, complete information; no multiple accounts.
- Phone-number verification via SMS code at sign-up.
§ 4 Free & Pro
- Pro Weekly: €9.90/week, auto-renewing.
- Pro Monthly: €24.90/month, auto-renewing.
- Pro Quarterly: €49.90/3 months, auto-renewing.
- Pro Yearly: €99.90/year, auto-renewing.
- Pro Lifetime: €179.00 one-time, no renewal.
Billing via Apple App Store or Google Play. Cancel in your store subscription settings.
Auto-renewal: Payment will be charged to your iTunes or Google account at confirmation of purchase. Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Renewal is charged within 24 hours of the end of the current period at the then-current price. You can manage your subscription and turn off auto-renewal at any time in your App Store / Google Play account settings.
§ 5 Right of Withdrawal
14-day statutory right of withdrawal for in-app purchases. The right lapses once the digital service is provided if you have expressly agreed and acknowledged that the right lapses (§ 356(5) BGB). Withdrawal declarations: email support@themalla.app or use Apple's (reportaproblem.apple.com) / Google Play's refund flows.
§ 6 User Obligations / Permitted Content
- No harassment, hate speech, discrimination or incitement to violence.
- No sexualised content involving minors; no pornographic content; no non-consensual content.
- No commercial use (ads, sex work, sales) without written approval.
- No fake profiles, identity theft or fraud.
- No illegal, defamatory or copyrighted content without rights.
- No technical attacks, scraping, bots, reverse engineering.
We may remove content and suspend accounts violating these rules or our Community Guidelines.
§ 7 Notice & Action Procedure (DSA)
Under the EU Digital Services Act (DSA), you can report illegal content in the app (Profile → Report) or by email to support@themalla.app. We review reports, inform you of the decision and provide reasons for restrictions. An internal complaints process is available; you may also contact an out-of-court dispute settlement body under Art. 21 DSA.
§ 8 License (Apple / Google)
For installs via the Apple App Store, Apple's Licensed Application End User License Agreement additionally applies (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Apple and you are the direct parties to the app license. For Google Play installs, the Google Play Terms of Service apply. Conflicts are resolved in favour of the more consumer-friendly rule.
§ 9 Liability
Unlimited liability for intent and gross negligence and for injury to life, body or health. Otherwise limited to typical, foreseeable contractual damages. We accept no liability for user-generated content or for meetings, events or interactions between users outside the app; please follow the safety guidance in our Community Guidelines.
§ 10 Termination
Delete your account anytime: Settings → Account → "Delete account". Pro subscriptions run until the end of the paid period and will not renew. Cancel the subscription itself only via Apple or Google Play.
§ 11 Changes
We communicate material changes 30 days before they take effect via email and in-app. If you do not object before they take effect, the amended Terms are deemed accepted; if you object, you have a special right of termination.
§ 12 User-generated Content / License
You keep all rights to the content you post on malla (photos, bio, chats, event content). To operate the service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, create derivative copies (cropping, compression, moderation hashes), transmit and display that content to other users within the app. The licence ends when you delete the content or your account, except for technically required backup / security copies.
You represent that you have the necessary rights to the content you post and that you do not infringe any third-party rights (incl. copyright, personality and trademark rights).
§ 13 Copyright Notice & Takedown (DMCA)
We respect intellectual property. Rights holders may report content to support@themalla.app with: (1) an electronic or physical signature, (2) description of the copyrighted work, (3) description and location of the allegedly infringing material in our app, (4) contact details, (5) a good faith statement and (6) a statement that the information is accurate. We remove reported content, notify the uploader, and may restore it after a valid counter-notice unless litigation is filed.
§ 14 No Warranty / Use at Your Own Risk
We strive for reliable operation but cannot guarantee uninterrupted, error-free availability. To the extent permitted by law, the app is provided "AS IS" and "AS AVAILABLE". Consumer rights under §§ 327 et seq. BGB (digital products) remain unaffected.
Safety notice: We do not verify the identity or intentions of other users beyond the limited checks described. Any encounters, meetings, travel or events with other users are at your own risk. Follow our Community Guidelines, meet for the first time in public places and tell someone where you are.
§ 15 Indemnification
To the extent permitted by law and where you are not acting as a consumer, you will defend and indemnify us from third-party claims resulting from your culpable breach of these Terms, of applicable law, or of third-party rights via content you post or your conduct, including reasonable legal defense costs.
§ 16 Force Majeure
We are not liable for service disruptions due to force majeure (natural events, governmental orders, large-scale network or cloud outages, war, pandemics) that are outside our control.
§ 17 Notices
Legal notices to you will be sent to the email on file or posted in the app. Notices to us: support@themalla.app.
§ 18 Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, except as provided in §19 for U.S. users. Mandatory consumer-protection rules of your EU country of residence remain unaffected. Place of jurisdiction is Hamburg, to the extent legally permitted. If any provision is invalid, the remainder remains effective and the invalid provision is replaced by the permitted rule closest in economic effect. Changes require text form.
§ 19 Additional Terms for U.S. Users
If you use the app from the United States, the following additional terms apply (expressly not to EU / UK consumers where mandatory law conflicts):
- Arbitration & class-action waiver: Any dispute will be finally resolved by binding individual arbitration under the American Arbitration Association (AAA) Rules (seat: Wyoming; English). You and we waive class actions and jury trials. Within 30 days of accepting these Terms you can opt out of arbitration by emailing support@themalla.app with subject "Arbitration Opt-Out".
- Governing law (U.S.): The laws of the State of Wyoming (without regard to conflict-of-laws rules).
- Liability cap: To the extent permitted by applicable law, our aggregate liability is limited to the greater of (a) amounts you paid us in the prior 12 months or (b) USD 100.
